Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and SleekPixel PTY LTD ("Company," "we," "us," or "our") concerning your access to and use of our website, products, and services (collectively, the "Services").

Payment and Billing

We reserve the right to change our pricing at any time. If you have a subscription, price changes will not affect your current billing period but will apply to subsequent billing periods with advance notice.

Payment Terms

Refunds

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL SLEEKPIXEL PTY LTD, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or use
• Cost of substitute services
• Business interruption

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or $100 if no payment was made.

Indemnification

You agree to indemnify, defend, and hold harmless SleekPixel PTY LTD and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorney's fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent, illegal, or harmful activities
• Extended periods of inactivity
• Request by law enforcement or government agencies

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Dispute Resolution

Informal Negotiations

To expedite resolution and control the cost of any dispute, you and we agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration or litigation.

Binding Arbitration

If informal negotiations fail, any dispute arising from these Terms or the Services shall be resolved through binding arbitration, except that either party may bring an action in court to:

• Seek injunctive relief
• Address claims in small claims court

Governing Law

Miscellaneous

Entire Agreement

These Terms, along with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and SleekPixel PTY LTD regarding the Services.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights without restriction.
